Privacy Policy - The Protection of Personal Information Act
This Privacy Policy describes our policies and procedures on the collection, use and disclosure of Your information when You use the Services provided by Action iT and informs You about Your privacy rights and how the law protects You.
We use Your Personal data to provide and improve our Services. By using one of our Services, You agree to the collection and use of information in accordance with this Privacy Policy.

Definitions
For the purposes of this Privacy Policy:
1.1 Client means the individual accessing or using a Service(s), or the company, or other legal entity on behalf of which such individual is accessing or using the Service(s), as applicable.

In order to make use of the services and in order for Action iT to render professional services, advise or intermediary services accurately the client may have to provide certain personally identifiable information that can be used to contact or identify them.
Personally, identifiable information may include, but is not limited to:

3. Use of Your Personal Data
The Company may use Personal Data for the following purposes:

For the performance of a contract: the development, compliance and undertaking of the contract for the products, items or services purchased by the client or of any other contract with Action iT through the Service(s).

To contact: To contact the Client by email, telephone calls, SMS, or other equivalent forms of electronic communication, regarding updates or informative communications related to the products, services and the client portfolio, contracted services, when necessary or reasonable for their implementation.

To provide the client: With news, special offers and general information about other goods, services and events which offered by the Company which are similar to those that have already purchased or enquired about unless the client has opted not to receive such information.

To manage clients’ request: To attend and manage the clients’ requests and instructions.

For other purposes: Action iT may use client information for other purposes, such as data analysis, identifying trends, determining the effectiveness of promotional campaigns and to evaluate and improve the Service, products, services, marketing and client experience.
4. Transfer of Personal Data
Client information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of South Africa or other governmental jurisdiction where the data protection laws may differ than those from South Africa.
The clients consent to this Privacy Policy followed by submission of such information represents agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that data is treated securely and in accordance with this Privacy Policy and no transfer of Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of such data and other personal information.
5. Legal requirements for Disclosure of Personal Data

Action iT will take every reasonable measure to keep data protected however, no method of transmission over the Internet, or method of electronic storage is 100% secure. While Action iT strives to use commercially acceptable means to protect Personal Data, absolute security cannot be guaranteed.

Action iT does not undertake any business which addresses any person under the age of 16.
8. Policy Principles for the lawful processing of personal information

Action iT will take reasonable steps to ensure that personal information obtained from clients is stored safely and securely.
This includes the following personal information: contact details, financial information, any information required under the FIC and other regulations and any other personal information that may be obtained for the purpose of providing its services to the client.

Action iT will collect adequate, relevant and not excessive personal information directly from clients.

Action iT will only process or release client information with their consent, except where it is required to do so by law, regulation, contract etc.

Action iT collects specific, explicitly defined and lawful purpose related to a function or activity personal information from clients to enable Action iT to represent them for the purpose of rendering its services which include:

Access to one or more module(s) on the Action Assist Performance Management system hosted on https://assist.action4u.co.za;

Access to the Professional Services that can be provided by the Action iT resources;

Access to the FSP approved Long-Term and Short-Term Deposits that can be provided to clients through the Investec Corporate Cash Management (CCM) Platform.

Personal information may not be processed further in a way that is incompatible with the purpose for which the information was collected initially. Action iT collects personal information for the purpose of rendering the professional and / or financial services, and it will only be used for that purpose.

Action iT is responsible for ensuring that client information is complete, up to date, accurate, and not misleading before it is used. This means that it may be necessary to request clients, from time to time, to update their information and confirm that it is still relevant.

In the instance that personal information is collected from a source other than directly from a client, (E.g., credit checks, AML checks, Astute checks, other portals), the client will be made aware:

Who is collecting their information by giving them our details;

8.7. Principle 7: Security safeguards

Action iT will ensure technical and organisational measures are maintained to secure the integrity of personal information, and guard against the risk of loss, damage or destruction thereof. Personal information must also be protected against any unauthorised or unlawful access or processing.

Action iT is committed to ensuring that information is only used for legitimate purposes with client consent and only by authorised employees and third parties which have been disclosed.
8.8. Principle 8: Participation of individuals

Clients are entitled to know particulars of their personal information held by Action iT as well as the identity of any authorised employees that had access thereto. Clients are also entitled to correct any information held by Action iT.
Changes to this Privacy Policy
Action iT may be required to update its Privacy Policy from time to time. Clients are advised to review this Privacy Policy periodically for any changes.
